27/11/2020 UPDATE

The numerous iterations of this Voter Registration Law from 2007 t0 2016 set out in this page have now been repealed, with effect from 19 October 2012, by the new Consolidated Elections Law covering the elections of the President, the House of Representatives and the nation-wide local councils, as well as the separate voter registration law. The new consolidated law is titled,  in Somali, Xeerka Doorashooyinka iyo Diiwaangelinta Cod-bixiyaasha, Xeer Lr. 19/2020, and has come into force on its gazetting on 19 October 2020.

UPDATES: March & April 2017:

02/04/2017: Report by the International Observers on the Somaliland 2016 Voter Registration Process (Authors: Marie-Luise Schueller and Michael Walls - published by Progressio, March 2017- also available at Progressio Website)

We are very pleased to note that key recommendations that we have made in previous election observation reports are being addressed, principally in this case the introduction of a credible voter register. While the current process has not yet been finalised, the registration itself appeared to proceed remarkably efficiently”(p. 32)

 

27/03/2016: The Somaliland National Electoral Commission announced the schedule for the distribution of the Voters’ Cards of the persons who registered themselves. The first phase starting  on 29 April 2017 covers the Regions of Awdal, Saaxil and the coastal areas of Sanaag Region. The second and third phases which will commence after Ramadan (which ends in the last week of June 2017) will cover respectively Maroodi-jeex and Togdher Regions, , followed by Sool and Sanaag.

 

On 28 March 2017, The Commission publicised the preliminary figures of the total voters registered (in all the 22 ‘Electoral’ Districts in the 6 ‘Electoral’ Regions of the country) in this Table (see also the SNEC announcement). The total valid registrations was 873,331, with the capital region (Maroodijeex having the largest regional number, 312,634 and Sool, the lowest number of 71,096 - the other 4 regions falling in between 78,506 (Sahil) to 178,506 (Togdher).

 

26/07/2016:  The much needed Amendments to the 2014 Voters Registration (Amendments & Additions) Law relating to the period before the March 2017 elections during which the National Electoral Commission must publish the final Voters’ Register Lists which was previously laid down as being six months before the polling date have now made so that the period is now flexible and  “within six months” of the polling date. An Annexe numbered one has been added to the Law which amends Articles  7(2) and 26(2)   of the 2014 Law (only) which states so accordingly, and has been gazetted in the May 2016 Somaliland Official Gazette dated 4 June 2016.

    Comment: These amendments give the NEC latitude in producing the final Voters’ Registration Lists and in working out a sensible timetable from the date of finalisation of the lists to the fixed polling date. It unfortunate, however, that the wording of the amendments has not made much more precise i.e “within the six months period preceding the polling date” etc. Secondly, I repeat my previous call that Parliament must revise this confusing system of keeping the number and title of the old law and then constantly adding “Amendments and Additions”  as Annexes upon Annexes, all retaining the same original reference of the first 2007 Law. Before the comprehensive 2014 Amendments, the 2007 Law was already amended 3 times, and with the 2014 Amendments and now this Annexe, the 2007 Law would have now been amended 5 times, each one of them still carrying the same date and reference of the first Law. A much more practical   option is to ensure that each Amending Law is given a separate  and clear title stating “Voters’ Registration (Amendments No 1 or No. 2  or No. 3 etc as appropriate) Law” followed by the year  or date when the amending Law came into force. It is also time that the year (or full date)  of Laws  should be the year when they are promulgated and (draft) laws or bills numbered the year they were first introduced into the House should change their numbering when they become Law. This means that that there will be a separate numbering system for draft laws (bills) and for promulgated final laws so as to minimise confusion and ensure that the each year’s laws are identified in sequential numbers and dates or year. There were similar systems  for both Ordinance (and Laws from 26 June 1960) in Somaliland (with a number and date of promulgation) and also in Somalia. There are other ways also  of numbering and referencing bills and laws, but the current system adopted by the House of Representatives needs changing perhaps from the start of 2017.

07/01/2016: Presidential Decree (dated 3 January 2016) announces the commencement date of the 2016 Voter Registration as being 16 January 2016 with Togdher as the first region whose voters will be registered.

 

08/05/2015: The Somaliland Official Gazette 02 May 2015 (Issue 4) published a Corrigendum of the Voter Registration (Amendments & Additions) Law which was previously published in Issue 12 of the Gazette dated 03 January 2015 (see below). The corrections follow the text of the Law  published at the HoR Website on 31 March 2015 whilst the January gazetted version followed to the version of the Law previously published at the HoR Website in January 2015. For an English language of summary of the corrections see below

In summary:

  • The Final correct version of the Law is therefore the 31 March 2015 HoR website version (large pdf file - see below).

This is essentially a reproduction of the 31 March HoR website version.

15/04/2015: UPDATE: A new text of the Voters Registration (Amendments & Additions) Law has been published at the House of Representatives (HoR) website on 31 March 2015, which replaced the earlier final text  that was previously available at HoR website. The text on the whole the same is the same as the one as before, but it is different in a few places from both the previously HoR published final text (which appeared at the HoR in early January 2015) and also the official text of the Law published in the Somaliland Official Gazette on 03/1/2015 (Issue 12 of 2014) (see below for these earlier versions).  There are, as yet,  no official explanations so far as to  how all this came about, but apparently  a FINAL official corrected text will be appearing in the next Somaliland Official Gazette to be published  early next month (May) as a corrigendum (correction).  (See above, now - 08/05/2015)

Our comparison of the new HoR text of the Law and the previously published texts  of the final Law show that some of the differences are typographical corrections, but a few others are substantive changes to the previously texts.   We  have highlighted in  the new HoR published text  (available above) these differences - in yellow - and they  relate to the following articles of the Law: 

 

    1. Article 2 Definitions:

    “The Register”  and “The General Register” which were both  relating to the voters’ registers and did not mention citizens’ identity registers as they referred only to voters  had both added to them a phrase to the effect that they will both also hold “the particulars of the citizens”. The previous wording followed the definitions of the 2007 Voter Registration Law, and in any case Article 4(1) and 4(2)  of the Law deal with the  citizenship register and the voter register separately.

    Comment: If there was a need for a further clarification of the two Registers, it might have been better to simply refer to each register separately.

    The definition of the “Regional or District Register” which again previously only related to the voter registers at these levels had added to it the registers “of the identity card or voters’ card” at the region or district.

    2. Article 7The title “Custody of Registration” has been amended to include the additional phrase “and the production of the final lists”.

    3. Article 25(2)Correction of the word “Ministry” to read “Identity”.

    Comment: This and item 7 below were both necessary textual corrections.

    4. Article 26(2)The previous reference to the period of two months” before the election polling date for the publication of the voter register list (which was in both the final Gazetted version of the Law and in the previously HoR published January version of the final law, as well as the Bill originally published in the HoR website bills section) now reads in this new 31 March HoR published final Law version “six months”. 

    Comment: Even the 2007 Voter Registration Law referred to the start of the implementation of the voter registration period as being no later than six months prior to the polling date (Article 12(1)) and that the registration officers shall reach the registration stations five months before the polling date (Article 27(1)), with the registration being undertaken during a period of not less than one month and not more than three months (Article 12(2)). So a change from two months to six months for the final stage of the production of the voter register would mean the whole process has to be started months and months in advance of this deadline and, in our view, mandates an unnecessary long period to lapse between the production of the registers and the polling date.  This requires, in our view an amendment as soon as possible, together with any other amendments/additions the National Electoral Commission proposes so as to enable the holding of the election as soon after  the voters’ lists are finalised and any corrections are made promptly thereafter. 

    5. Article 28 – This Article as previously published and gazetted read: “The National Electoral Commission shall, after consulting the national parties, announce the time the voter registration is commencing, and it shall so inform the President”. This was actually a  change to the corresponding Article 12(6) of the 2007 Voter Registration Law and the latest HoR version of this Amending Law returns to a wording essentially the same as  that in the 2007 Law by stating that  “the President shall announce the date of the commencement of the voter registration by issuing it in a Presidential Decree within fifteen days of receiving the proposal of the National Electoral Commission”.

    Comment: Indeed the President issued such a Decree recently on 12 April 2015, announcing that acting on the recommendation he has received from the National Electoral Commission on 9 April 2015, the voter registration shall begin in all the regions of the country from 21 July 2015. This was the practice, as well under the 2007 Voter Registration Law.

    6. Article 42 This Article,  which is identical to Article 38 of the 2007 Voter Registration Law, currently reads in the final Gazetted Law as follows: “International and local observers or inspectors who are checking the proper conduct of the voter registration activities shall be approved by the National Electoral Commission which shall consult the Ministry of Internal Affairs about security matters”.  The same Article 42 in the  HoE version of the Law now reads as follows: “The details of the) International and local observers or inspectors who are checking the proper conduct of the voter registration activities shall be forwarded to the Ministry of Internal Affairs by the National Electoral Commission so that it (the Ministry) can reach decisions about their entry permits to the country.”

    Comment: The function of verification of the credentials and suitability of the observers or inspectors belongs to the National Electoral Commission and the function of issuing entry clearances lies with the Immigration Branch and Somaliland Legations abroad. The purpose of this change is therefore not clear at all.

    7. Article 44(3) There was a missing phrase “which cannot be converted into a fine” in connection with the prison term punishment set out in this paragraph which has now been correctly inserted.     

 

14/01/2015 Civil Society Position Paper on Issues of Voter Registration and the Electoral Systems (SONSAF): Recommendations on the Voter Registration and on the Presidential and HoR elections.

 

06/01/2015 [As published then] Somaliland Voters Registration (Amendments & Additions) Law - (Law No. 37/2007 as amended in 2014) (in Somali) was passed by both Houses and then signed by the President on 23/12/2014.  The Law  came me into force on 3 January 2015 when it was gazetted (Somaliland Official Gazette (2014) Issue 12, dated 03 January 2015). A copy of the gazetted Law (on its own)  is attached here. 

UPDATE 15/05/2015: Please see above. These previous Final versions of the Law which have been published by the House of Representatives and Gazetted in early January 2015 appear to have had corrections made to them as shown (above) in a new text published by the House at its website on 31 March 2015. We set out above the new HoR text  and the differences between it  and the final text of the Law as previously published and gazetted. We understand that the definitive text will be published as a Corrigendum (correction) in the next issue of the Official Gazette. We shall also be revisiting our our editoral comment below when the official text is available.

    Editor’s initial brief comments (06/01/2015): As the final 46 Articles version of this Law does not have the usual  ‘Repeal’ provision which was in the previous bill passed by the House (then numbered Article 43), it is the case that any of the previous provisions of the 2007 Voter Registration Law (as amended in 2008)) that is contradicted by a provision in the new law has been replaced but that the other 2007 Law provisions are still current and can be applied, where appropriate.   We have therefore left, below,  the 2007 Law and its amendment  for reference. Under Article 29(1) (and Article 45),  the National Electoral Commission (NEC) has been given the power to issue Regulations relating to the period of the voter registration and the procedure for voter registration, and, in drafting these Regulations, the NEC must give regard to the provisions of the 2007 Law (as amended) that have not been  clearly repealed by the new Law.

    It is now January 2014 and the fact that the new NEC has still to lay down the detailed voter registration Regulations before the voter registration commences as well as the legal requirement  in Article 26(2) of the Law that the NEC must produce the final Electoral roll (list) two months before the polling day both set tight deadlines if the joint elections have to happen as planned by June 2015 (??? - see now above the new 31 March 2015 text of the Law - Ed. 15/04/2015) . As both the Presidential and House of Representatives election are now planned to take place on the same date, the electoral laws relating to both offices need to be revised as well, at the latest,  within the next 2 to 3 months.

    Any slippage in the timetable must be discussed well in advance between the NEC, the parties and the Government. Ever since the first House of Elders’ Resolution term extension for President Egal on 12 January 2002, and their first term extension  for the then House of Representatives on 27 April 2002, It has always been my consistent view that delays in elections caused by organisational failures of not putting all the necessary arrangements for the polling in place in time for the end of term of office(s) was not a condition precedent for the extension of terms  by the House of Elders under Articles 83(5) or 42(3) of the Constitution which have been repeatedly relied upon by the House of Elders. The conditions precedent that could justify term extensions in Article 83(5) are existing  ‘security condition(s)’ and those for Article 42(3) are existing  ‘(d)ire circumstances (which) are: a wide war, internal instability, serious natural disasters, such as earthquakes, epidemic diseases, (and) serious famines’,  None of these conditions currently exist.

    As President Rayale and others have correctly stated, in the past, other than when vacancies arise as set out in the constitution (and the electoral laws),  a President and a a House of Representatives elected by the public in a general election can only be replaced by another  President or House elected in the same manner.  Therefore, when there is a slippage in the election time table, because of all kinds of organisational reasons including failure to meet legislative or practical requirements in time, the only alternative option, in my view,  is for the NEC to declare the minimum possible period of the delay (which must be in calendar months)  and then after the discussion with the 3 parties and the Government, a law can be passed (by  both Houses and the President) which should set that minimum NEC recommended extension period. If the NEC declares another short slippage, then the same law could be amended again for a further minimum period (of a calendar month or months).

REGISTRATION OF SOMALILAND CITIZENS & ISSUE OF IDENTITY CARD

Although it would have been more appropriate for the registration of citizens (and issue Identity Cards)  to have dealt with in a separate law which is  linked to  the Somaliland Citizenship Law as it is an on-going process, it has now become part, but a separate one,  of this Law. The 2007 Law Voter Registration scheme included in its Article 8 the issue of a Citizenship Card at the same time as the issue Voter Registration Card and that probably explains why the the two issues were put in one Law, this time.    Although under Article 25(1) of the 2014 Law, any person registering to vote in any of the national or local elections must have a Citizenship Card, it has been agreed, as a practical compromise, that  ‘in the event that it has not possible for some of the citizens to acquire a  Ministry  Identity Card, the Ministry of Internal Affairs shall confirm their citizenship at the voter registration centre’. As in the previous 2007 (as amended) Voter Registration Law. Note, however that Article 26(1) of the Law makes it clear that  ‘Only a citizen registered in  the Voters’ Register can vote in the elections of the nation’.

The registration has already started and is on-going. Other than Article 7 of the 2007 Law which specifically mentioned the issue of identity cards, citizenship registration was authorised under the following Regulations (mainly linked to the proper implementation of the 2002 Citizenship Law).  13 December 2011: The 2007 Voter Registration Law (Amendments Addendum No. 3) 2011 has be  signed into Law by the President on 13 December 2011. The Presidential Decree (No. 01810/122011) dated 13 December 2011 sets out in full the short amendment law which  makes the following five provisions:

  1. The voter registration held in 2008 has been voided. 
  2. The following District Councils elections only shall be held without a voters’ register.
  3. A new voter registration shall be undertaken prior to the next elections of the House of Representatives and the presidential elections, which will both be based on the new voters’ register.
  4. The amending article in the Election Law No. 20/2001 (relating to the voter registration) is repealed.
  5. Any provisions contrary to the above (four) clauses are  repealed.

Voter Registration Code of Conduct February 2009 [English]

 

 Somaliland Voter Registration Law - Law No: 37/2007

  (Please note that the Voter Registration undertaken under this Law in 2008 - 2009 has been voided - see the third Addendum to this Law (above) which came into force on 13 December 2011)

The Voter Registration Law was first passed in 2007 and was implemented by Presidential Decree No: 207 of 08/07/2007.  By the time the end of the term of office of the local councils in December 2007 was fast approaching, it was clear that the voter registration activities would not be concluded in time for the elections.  Even when the term of office of the local councils was extended, the end of the President’s term of office (May 2008) was also approaching.   One of the problems was that some people argued that Article Articles 13 and 27 of the Voter Registration Law required a gap of 6 months between the two elections. This was not strictly correct, but this argument was used by the House of Elders, on 10 April 2008, when it resolved to extend the President’s term of office by one year to 6 May 2009.  Nonetheless, as the registration was not yet started, the national Electoral Commission and the political parties felt that a number of overly restrictive provisions of the Voter Registration Law need to be amended (at least for this first round of elections) so that the registration can be completed as soon as possible.

The NEC and the parties, therefore, proposed amendments to the Law. These were forwarded by the President to the the House of Representatives, which approved them on 10 June 2008. The amendments were in the form of 12 Articles which were appended as a Schedule to the 2007 Law. The House of Elders proposed changes to 3 of the Articles, but when the Bill was returned to the Representatives, the latter insisted  on passing again, on 21 June 2008, the bill in its original  format . The Elders have no power to return a bill to the Representatives more than once, and whilst there were no reports of the Bill being returned to them by the Representatives, the Bill was forwarded to the President and, on 23 June 2008, and a presidential decree (signed by the Vice-President, during the President’s absence from the country) promulgated the Bill into Law.  Both the Amendments and the 2007 Law are set out below

    Presidential Decree issued under Art.12(6) of the Law on 23/07/2008, announced that the Voter Registration Period shall begin on 14 October 2008. The SNEC expect it to finish it in December 2008, in readiness for the presidential election now scheduled to take place on 29 March 2009.

AMENDMENTS TO THE VOTER REGISTRATION LAW (First Amendments Annex 2008)

NOTE (Feb 2015): As set out in Article 1 below, these 2008 Amendments had only ‘a temporary repealing effect’ on the Articles of the 2007 Law which they addressed, so that the then Voter Registration could be completed by through the implementation of these amended procedures. They were therefore a type of ‘sunset’ legislation whose effect has now gone with the completion of the 2007 to 2010 Voter Registration process which was later annulled on 13 December 2011 (see above). These Amendments are therefore no longer in force, but the 2007 Law is still in force, except ins so far it has been amended by 2014 Voter Registration (Amendments and Additions) Law (see above).

    ii.  Haddii Maalinta ugu dambaysa ee diiwaan-gelinta cod-bixiyayaasha ay soo hadhaan dad aan la diiwaan-gelinin, Komiishanka Doorashooyinka Qaranku waxa uu qaadayaa tallaabo kasta oo lagu xaqiijinayo in la diiwaan-geliyo dadka jooga Goobta ka hor waqtiga la xidhayo diiwaan-gelinta.

    iii. Goobihii cod-bixineed ee doorashadii u dambaysay, waxay noqonayaan goobo diiwaan-gelineed. Hase-yeeshee Komiishanka Doorashooyinka Qaranku wuxuu awood u leeyahay in uu sammeeyo goobo cusub ama in uu goobihii hore u jiray u raro ( beddelo) meelo kale si loo de-dejiyo geedi-socodka diiwaan-gelinta.

j)    Marxaladda Dhammaystirka Diiwaan-gelintu waxa ay ahaanaysaa mid daba socon doonta marxalladda diiwaan-gelinta rasmiga ah, soconna doonta muddo dhan 15 maalmood oo koox hawl-wadeeno ahi ka hawl-galayaan Xafiis kasta oo diiwaan-gelineed oo heer-degmo ah, si ay xogaha diiwaan-gelinta la xidhiidha uga soo qaadaan muwaadiniinta ka soo gaadhi waayay waqtigii Marxaladda diiwaan-gelinta rasmiga ahi socotay.

 

QODOBKA 3AAD

NIDAAMKA DIIWAAN-GELINTA RASMIGA AH.

Qodobkani waxa uu bedelayaa Qodobadda 12(1&2), 18 &19 ee Xeerka Diiwaan-gelinta cod-bixiyayaasha, waana sidan:-

Waa in la raaco dhammaanba tallaabooyinka soo socda marka la sammaynayo Diiwaan-gelinta rasmiga ah, una kala horeeya sidani:-

b)  Masuulka Wasaaradda Arrimaha Guduhu;

    i.     Wuxu waydiinayaa qofka in uu yahay muwaadin Somaliland ah, xaqiijin ka dibna waxa uu Wakiilka Maxkamaddu ku dhaarinayaa hortiisa, Muwaadin kasta oo is-diiwaan-gelinaya, da’diisuna ka yaraanayn 16 sanno Maalinta loo qorsheeyay Doorashada Madaxtooyada.

     ii.   Mas’uulka Wasaaraddu haddii uu ku qanco Jawaabta uu ka hello Isdiiwaan-geliyaha waxa uu u ogolaanaya in diiwaan-gelinta qofkaasi muwaadinimadiisu sugantay la sii wado.

t)  Hawl-wadeenka Komiishanka Dooarshooyinku waxa uu isagoo adeegsanaya  Kombuyuutarka Lap-tobka ah, ka qorayaa is-diiwaan-geliyaha xogta isaga la xidhiidha ee uu qeexayo Qoddobka 8aad ee Xeerka Diiwaan-gelinta Cod-bixiyayaasha, sidoo kalena waxa uu sawir elektaroonik (Electronic) ah, ka qorayaa is-diiwaan-geliyaha xogta isaga la xidhiidha ee uu qeexayo Qoddobka 8aad ee Xeerka Diiwaan-gelinta Cod-bixiyayaasha, sidoo kalena waxa uu sawir electroonika (Electronic) ah iyo farahaba ka qaadaya is-diiwaan-geliyaha oo uu kombuyuutarka gelinaya.

j)   Is-diiwaan-geliyaha, waxa loo akhrinayaa xogta laga qoray waana in la hubiyo in uu ogolaaday, ka dibna diiwaan-geliyuhu waxa uu ku xafidaya Kombuyuutarka.

x)  Mas’uulka Diiwaan-geliyaha ahi waxa uu ka soo saarayaa Kombuyuutarka;-

    i.     Laba nuqul oo isku mid ah, oo ah foomka diiwaan-gelinta, kuwaasi oo mid la siin doono Wasaaradda Arrimaha Gudaha ka kalena noqon doono diiwaanka Diiwaan-geliyayaasha.

    ii.    Kaadhka Muwaadnimadda iyo Kaadhka cod-bixinta doorashada.

Kh)  Mas’uulka ka socda Komishanka, ahna Guddoomiyaha Goobta, ayaa saxeexaya kaadhka cod-bixinta, halka uu mas’uulka ka socda Wasaaradduna uu saxeexi doono kaadhka muwaadinimadda. Labadda mas’uul waxa kale oo ay saxeexayaan labadda nuqul ee foomka diiwaan-gelinta. Is-diiwaan-geliyuhuna waa in uu suulka bidix dhigo ama saxeexo labadda foom iyo weliba kaadhka cod-bixinta doorashada iyo kaadhka Muwaadinimadda.

d)  Is-diiwaan-geliyaha waa in far-yaradda bidix ee gacanta loo geliya khadka aan masaxmin, haddii ay maqan tahayna faryarta midig ee gacanta. Haddii ay labadduba maqan-yiheinna laga mariyaa khadka meel uu ka muuqan karo oo jidhkiisa ah.

r)   Is-diiwaan-geliyaha waxa isla - goobtaasi lagu siinayaa kaadhka muwaadnimadda iyo kaadhka cod-bixinta doorashadda.

 

QODOBKA 4AAD

NIDAAMKA DHAMMAYSTIRKA DIIWAAN-GELINTA

Qodobkani waxa uu beddelayaa oo uu halkiisii gelayaa, Qodobadda 12(1& 2), 18 & 19. Sidoo kalena waxa uu wax ka bedelayaa Qodobka 14aad ee Xeerka Diiwaan-gelinta Cod-bixiyayaash,a waana sidan:-

1.  Nidaamka loo racaayo hir-gelinta marxalladda dhammaystirka diiwaangelintu waxa uu noqonayaa nidaam la mid ah ka loo raacay hir-gelinta Marxaladda diiwaan-gelinta rasmiga ah ee cod-bixiyayaasha. Hase yeeshee is-diiwaan-geliyaha, isla marka la diiwan-geliyo la siin maayo kaadhka codbixiyaha iyo kaadhka muwaadinka, halkoodii waxa laga siinayaa nuqul daabacan oo muujinaya xogtii isaga/iyada laga buuxiyay ee la geliyay kombuyuutarka;

2.  Marka uu Komiishanku soo af-jaro hubinta in aanay jirin dad hal mar in ka badan is diiwaan-geliyey, ayaa kaadhka cod-bixinta iyo kaadhka muwaadinimadda laga siinayaa is-diiwaan-geliyaha, isla xafiiskii uu hore isaga diiwan-geliyey, isagoo la imanaya halkaasi nuqulkii daabacnaa ee laga siiyay Xafiiska Diiwaan-gelinta Degmadda;

3.   Muddada lagu jiro marxaladda dhammaystirka Diiwaan-gelinta lama dabaqayo xarfaha  (t) iyo (j) ee Qodobka 14ad ee Xeerka Diiwaangelinta Cod-bixiyayaasha, marka la diiwaan-gelinayo, waa in uu muwaadinku cayimo goobta uu jecel yahay in uu ka coddeeyo, taasi ayaana lagu Diiwaan-gelinayaa Foomka diiwaan-gelinta iyo labada kaadhba, halkaasi ayuun baanu muwaadinkaasi ka dhiibanayaa codkiisa Maalinta Doorashada, meel kalena ka coddeyn maayo.

 

QODOBKA 5AAD

FOOMKA DIIWAANGELINTA

Qodobkani waxa uu wax-ka-beddel ku sammaynayaa, isla markaana kaabaya qoddobada, 8,(7 & 9) iyo 31(4 & 5), waana sidan;-

Lambarka Diiwaan-gelinta u gaarka ah ee lagu xusay Qoddobka 8aad ee Xeerka Diiwaan-gelinta Cod-bixiyayaashu waa inuu la mid yahay kuwa u gaarka noqonaya  kaadhka cod-bixiyaha iyo kaadhka muwaadinka.

  

QODOBKA 6AAD

XIDHISTA DIIWAAN-GELINTA

Qoddobkani waxa uu kaabayaa oo habeynayaa Qoddobada 27 & 30 ee Xeerka Diiwaan-gelinta Cod-bixyayaasha, waana sidani.

b)  Mar haddii ay Gobollada ka dhammaato marxaladda dhammaystirka Diiwaan-gelintu ma jirayo qof dambe oo la diiwaan-gelinayaa.

t)   Waxa diiwaan-gelin la samayn doonaa uun ka dib marka ay dhaamaadaan Doorashooyinka Goleyaasha Deegaanada iyo ta Madaxtooyada ee xilligani 2008/2009.

j)   Komiishanka Doorashooyinka Qaranka ayaa ku dhawaaqaya wakhtiga dambe ee Diiwaan-gelinta Cod-bixiyayaasha dib loo furayo.

KU DHAWAAQIDDA WAKHTIGA DIIWAAN-GELINTA (REGISTRATION CALANDER)

Qoddobkani waxa uu wax ka beddelayaa Qoddobka 12aad (3) ee Xeerka  Diiwaan-gelinta Cod-bixiyayaasha, waana sidan:-

Kalalka (Wakhtiyada) Diiwaan-gelinta Gobollada waxa ku dhawaaqaya oo faafinaya Komiishanka Doorashooyinka Qaranka, isagoo adeegsanaya aaladaha war-baahineed ee Dalka ka jira, waana in uu xil gaar ah iska saaro Komiishanku, si uu u xaqiijiyo in muwaadiniinta Gobol kasta ogaaddaan kalka/wakthiga loo cayimay gobolkooda, inay ka qabsoonto diiwaan-gelinta cod-bixiyayaashu.

Qodobkani waxa uu bedelayaa oo uu halkoodii gelayaa Qodobada 22 iyo 23(1) ee Xeerka Diiwaan-gelinta Cod-bixiyayaasha, waana sidan:-

 1.  Muddada lagu jiro marxladda Diiwaan-gelinta Rasmiga ah, dhammaanba Qalabka iyo agabka kale ee loo adeegsaday Diiwaan-gelinta iyo waliba natiijada ka soo baxday hawsha la qabtay maalintaasi, waxa meel ammaan ah ku xafidaya oo hayntooda u xilsaaran masuulka uu Komiishanku Doorashooyinku u xilsaaro hawshaasi iyada ah.

Ka hor Maalinta ay dhacayso doorashada hore, Komiishanka Doorashooyinka Qaranku waxa uu goob kasta oo cod-bixineed geynayaa foomam loogu talo galay, in muwaadiniintu ku soo gudbiyaan wixii cabasho ah ee la xidhiidha Diiwaan-gelinta, kuwaasi oo komishankuna ka go’aan gaadhayo ka hor Doorashada labaad.

   

QODOBKA 10AAD

DAABACAADDA IYO SOO BAN-DHIGIDDA LIISASKA

Qoddobkani wuxuu wax ka beddel ku samaynaya Qoddobka 27aad  ee Xeerka Diiwaan-gelinta Cod-bixiyayaasha, waana sidani:-

a)   Liiska Muwaadiniinta iska-diiwaan-geliyay Goobaha, kana coddayn doona oo daabacan kuna daabacan waraaqaha Rasmiga ah ee Komiishanka Doorashooyinka Qaranka, lehna Shaanbadda Xafiiska waa in lagu dhajiyaa Goob doorasho-kasta oo cod-bixineed laba bilood gudahood Maalinta Doorashada loo muddeeyay in la qabto.

b)   Qodobada 13aad, 27aad iyo 28aad ee Xeerka Diiwaangelinta Codbixiyayaasha laguma dabaqayo diiwaangelinta Codbixiyeyaasha Doorashada ugu soo horreysa, marka laga reebo wixii laga soo qaatay qodobadaasi ee ku jira lifaaqan.

Diiwaanka guud  waa in la dhigo xarunta Komishanka qaranka, waxaana maamuli doona Waax gaar ah oo uu madax ka yahay mas’uulka diiwaanka codbixiyeyaasha ee Qaranka, oo ay magacaabayaan komishanka qaranku, waxa kale  oo jiraya diwaanka gobolka, degmada, iyo goobta.

Diiwaanku waa hanti ummadeed waxaanu u furan yahay dadweynaha. Xisbi kasta oo siyaasadeed waxa uu xaq u leeyahay in uu la socdo habaynta, dhaqan-gelinta, iyo daabacaadda  Diiwaanka. Muwaaddin kasta waxa uu xaq u leeyahay in uu Xarunta uu yaallo Diiwaanku uu ka helo xog kasta oo uu u baahdo oo ku saabsan arrimaha Doorashooyinka.

 

Qoddobka 7aad

Hawl-galka diiwaan-gelinta Cod-bixiya-yaasha & sugidda Muwaadinimadda

Bilawga Hawl-galka diiwaan-gelinta cod bixiya-yaasha waxa sal-dhig iyo gun-dhig u ah Qoddobadan soo socda oo ay waajib tahay in la dhammaystiro.

1)        Marka diiwaan-gelinta la sammaynayo waa in la sugo Muwaadinnimada Qofka Somalilanderka ah (Nationality ID card) iyo tan Diiwaan-gelinta cod-bixiyaha (Registration Card) oo mar la wada qabanayo, is-diiwaan-gelinta ugu horaysa  oo kaliya

2)       Maadaama Xeerka Jinsiyada xeer lambar 22/2002 Qoddobkiisa saddexaad (3) farqada 1aad Xarafka A & B anu sahli karin, lana jaaan-qaadi karin sugida Muwaadinnimada & Diiwaan-gelinta cod-bixiyaha, iyada oo aan laga heli karin Maxkammadd goob-kasta,  ayaa waxa leh awoodda bixinta Aqoonsiga Muwaadinka Wakiiladda Wasaaradda Arrimaha Gudaha iyo Wakiilka Maxkammada, iyada oo ay goob-joog yihiin Wakiiladda Komishanka & Xisbiyada. 

3)       Goob kasta oo diiwaan-gelineed waxa ka hawl-galaya:

    1         Wasaarada Arrimaha Gudaha laba Xubnood

    2         Wakiilka Maxkammada Hal Xubin

    3         Komishanka Qaranka laba Xubnood

    4         Wakiilada Xisbiyada Saddex Xubnood

 Qoddobkani waxa uu si gaar ah dhaqan gal u ahaanaya xilliga diiwaan-gelinta cod-bixiyayaasha ee u horaysa. Wakhtiyda lagu jiro xilliyada aanay diiwaan-gelinta cod-bixiyayaashu jirin waxa la adeegsanaya Qoddobka 3aad ee Xeerka Jinsiyada Xeer Lambar 22/2002.

4)       Diiwaan-gelinta waxa loo raacayaa heerarkan ama jaran-jarooyinkan :-

    b.      Qofkasta oo raba in uu is diiwaan-geliyo wuxu soo maraya Wakiiladda Wasaaradda & Wakiilaka Maxkammada ka dib marka ay sugnaato muwaadinnimadiisnau wuxu u gudbaya Wakiiladda Komishanka oo diiwaan-gelin doona iyaga oo Wakiiladda Axsaabtuna ay goob joog-yihiin.

    t.       Waxa isla goobtaasi lagu wada siinaya qof kasta oo ay u sugnaatay Muwaadinimadiisu Kaadhka Muwaadinimadda (Nationality Card) iyo kan diiwaan-gelinta cod-bixiyaha (Registration Card).

    j.         Marka ay sugnaato Muwaadinnimada qofka is diiwaan-gelinaya, laguna dhaarto in uu muwaadin yahay waxa uu Mas’uulka Wasaaraddu gelinaya formka rasmiga ah,waxana lagu qorayaa magaca oo afran, sanadka dhalashada lab & dhedig in uu yahay qof xaas leh iyo in kale, ka dibna Mas’uulku ku saxeexo wakiilka maxkammada hortiisa.

5)       Qofka ay Wasaaradda & Maxkammadu ay sugi kari waydo Muwaadinimadiisa waxa lagu war-gelinayaa in uu wakhti cayiman Guddigga horteeda ku keeno Caaqil, haddii ay suurta-geli waydana uu keeno qof la yaqaan oo Hanti ma-guurta ah ku leh Degaanka, oo caddeeyaa in uu yahay muwaadin Reer Somaliland ah, kuna dammiinto hantiddiisa.

6)       Maxkammadaha Racfaanka ee Gobolladda ayaa magaacabaya Wakiiladda Maxkammadaha ee uga qayb-gelaya goobaha diiwaan-gelinta cod-bixiya-yaasha, Wakiiladda maxkammadaha & xisbiyadu waa in ay sitaan warqad Wakaaladda  rasmiga ah iyo kaadhadh aqoonsi (ID card).

1.      Si loo dhaqan-geliyo Diiwaan-gelinta, Komishanku waa in uu shaqaaleeyaa shaqaale khibrad iyo xirfad u leh dhaqan-gelinta Diiwaan-gelinta, oo ay ka mid yihiin:

    a)       Mas’uulka Diiwaanka Qaranka oo mas’uul ka noqon doona maamulka Diiwaanka islamarkaana ah madaxa Waaxda Diiwaan-gelinta cod-bixiyeyaasha ee Xarunta Komishanka Doorashooyinka Qaranka;

    b)       Mas’uulka Diiwaanka ee Gobol kasta;

    c)        Mas’uuka Diiwaanka ee Degmo kasta. Haseyeeshee Degmooyinka ay ku nool yihiin dadweyne badani, Komishanku waxa uu xafiisyada Diiwaan-gelinta ee heer Degmo u magacaabi karaa in ka badan hal mas’uul, si hawsha doorashadu si habsami ah ay ugu dhaqangasho oo loo qabto;
